Joel Nolan, CMD '00, Publishes Article in The New England Law Review

Joel Nolan, a 2000 alumnus of the CMD program, is currently a law student at the New England School of Law.  Additionally, he has taken on the responsibilities of Business Managing Editor of the New England Law Review where he leads a staff of 60 students through the quarterly publication of its scholarly articles.

As an Associate on the Law Review, Nolan recently authored an article entitled, “Chipping at the Iceberg:  How Massachusetts Anti-discrimination Law Can Survive ERISA Preemption and Mandate the Extension of Employee Benefits to All Married Spouses Without Regard to Sexual Orientation” which will be published in the Fall of 2007.  His article was selected as the Law Review’s nominee for the national Scribes Award competition.

Nolan quipped, “Catchy title, right?”  He went on to explain, “The article is about ERISA’s preemption provisions and same-sex marriage. The argument is that state, not federal, anti-discrimination law should control when an employer refuses to extend employee benefits to the spouse of a same-sex married employee.  It’s actually pretty interesting and will certainly be a hot topic in coming years.”

This summer, Nolan is working as a Summer Associate for the Boston law firm Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C.  Eventually he plans to practice employment and labor law.  Before law school, Nolan worked as a marketing analyst for Calpine Corporation, and earned a masters of science degree in Human Resources Management from Suffolk University.
